Planning

Alterations or extensions to a property may require planning permission, particularly if it is in a local conservation area.  A single family dwelling have some permitted development rights, all other properties do not.

 

Listed Buildings

Listed Building require building consent for any internal or external material alterations.

Building Regulations

Most Structural alterations require Building Regulations approval, applied for by either Building Notice or Full Plans Approval.  Small works are general completed under a Building Notice, served by the contractor on the Local Building Control department before work commences.  Approval is required for non-structural elements such as insulation, ventilation and glazing.

 

Party Walls

Under the Party Wall Act 1996, building work that affects a wall or fence adjoining or shared with a neighbour or excavations within 3m require Notice and a Party Wall Award

 

Buildings Insurance

Prior to commencement of any works the leaseholder/freeholder must advise their insurer of the proposed works.  Contractors are not obliged to take out building insurance unless this is specifically required in the Contact.  The building owner should ensure adequate building insurance is in place for the works; either provided by the owner or contractor

Construction Design and Management Regulations

The Regulations by law impose certain duties on the individuals and companies commissioning the work with respect to Health & Safety matters.  If in doubt about whether the Regulations apply or not, professional advice should be sought.

Normally these do not normally apply to private freehold owner/occupier of residential properties where the work is undertaken by the owner as a private individual.
